ABSTRACT: This article considers the inter-relationship of artistic expression with blasphemy law, in the context of the European Convention on Human Rights. Recent developments relating to the law of blasphemy both in Strasbourg and in the national courts are examined, and the significance attached to the artistic nature of expression by the courts in blasphemy cases is assessed. Recent decisions, in particular that of the European Court of Human Rights in Wingrove v. United Kingdom, have preferred to leave the application of blasphemy law to be determined at a local rather than a supranational level. The author suggests that, in endorsing national blasphemy laws, the Court of Human Rights has implicitly upheld freedom of religion over freedom of expression, and has permitted the silencing of artistic enterprise to an unjustified extent. The author advocates a better appreciation by the courts of the distinct nature of artistic expression, and proposes that such expression should be immune from the reach of the law of blasphemy
