On 22 February 1991 Portugal submitted an application to the International Court of Justice (ICJ) instituting proceedings against the Commonwealth of Australia. Portugal was acting on behalf of, and in the interest of, the people of East Timor in bringing the claim, while simultaneously defending its own interests. In 1989 Australia concluded an agreement with Indonesia concerning the delimitation and the exploitation of the continental shelf of East Timor. According to the Portuguese application Australia, inter alia, thereby infringed the right of the people of East Timor to self-determination. Beck, 1993. - ISSN 0938-5428 LANGUAGE: ENG ABSTRACT: Many recent activities of the United Nations Security Council have been carried out in the shadow of legal doubts.2 A prominent and disturbing example of apparently activist Security Council action is found in measures taken against Libya due to its alleged involvement in the bombing of a Pan Am flight over Lockerbie in Scotland in 1988. On 21 January 1992 the Security Council passed Resolution 731 which inter alia obliged Libya to extradite two suspected perpetrators of the crime to either the United States or the United Kingdom for trial in one of those countries. In response Libya brought an action before the International Court of Justice (ICJ) and requested the Court to indicate provisional measures to enjoin the United States from taking coercive actions against Libya and to ensure that no steps were taken that would prejudice Libyas's rights. Introduction The events leading to Indonesia's military invasion and subsequent annexation of East Timor, accompanied by repeated allegations of gross violations of human rights,3 are well known. The legality of Indonesia's claim to East Timor as constituting the 27th province of Indonesia has been the subject of much debate.4 Sixteen years after the occupation, proceedings were commenced in the International Court of Justice to bring Indonesia's claim and the contrary claim of the people of East Timor to their right to self-determination under judicial scrutiny. However these claims will be raised only in an indirect fashion and neither Indonesia nor East Timor are parties before the Court in the case which is being played out between Portugal and Australia.5 This article will discuss the way in which the issue of East Timor has been presented to the Court, and some of the arguments that are likely to be raised in the case.
