ABSTRACT: Kunnallisina tehtävinä sekä ystävyyskuntatoiminta että rauhantyö ovat niin uusia, ettei historiallinen argumentaatio juurikaan anna vastausta kysymykseen niiden suhteesta toimialaan.Sekä ystävyyskuntatoimikunta että rauhantyö liittyvät ulkopolitiikan alaan.Ulkopolitiikka on perinteisesti ollut valtion tehtävä, minkä vuoksi se on jäänyt kunnan toimialan ulkopuolelle.Oikeuskirjallisuudessa on todettu etteivät valtiotehtävät kuulu kunnalle, minkätakia kunta ei saa niitä suorittaa.Tätä kantaa tukevaa oikeuskäytäntöä on verrattain runsaasti.KHO:n kanta ystävyyskuntatoimintaan on vaihdellut.Artikkeli käsittelee KHO:n eri ratkaisuja ystävyystoimikunnasta, kunnan rauhantyöstä, pakolaisavusta ja humanitaarisesta avusta. As municipal matters both twin city activities and peace work are so new that no arguments based on history reveal anything about their relationship to the cities' field of activities.Both the twin city committee and peace work are part of foreign policy.Foreign policy has traditionally been the main field of interest of the state, and that is the reason why it has fallen outside the cities' field of activities.In literature on law it has been argued that state affairs do not belong to the cities.Consequently, the cities must not interfere in foreign policy.There are plenty of cases supporting this view. The Supreme Administrative Court has had various opinions about twin city activities.The article deals with different solutions by the Supreme Administrative Court concerning the twin city committee, city peace work, refugee aid and humanitarian aid.
