BIBLIOGRAPHIC LEVEL: part of a serial Does article 3 of the European convention on human rights enshrine absolute rights? / Addo, Michael K. ; Grief, Nicholas REFERENCE TO GENERIC UNIT (Periodica): European journal of international law [=EJIL] : vol. 9; no. 3., p. 510-524. - Firenze : European University Institute, 1998. - ISSN 0938-5428 LANGUAGE: ENG ABSTRACT: Article 3 of the European Convention on Human Rights, which prohibits torture and other forms of ill-treatment, does not expressly provide that its terms are absolute. Nevertheless, the idea that Article 3 contains absolute rights is generally accepted. This article explores the concept of absolute rights in Article 3, both with reference to theoretical considerations and in the light of Strasbourg case law. It concludes that the notion of absolute rights is nebulous because it involves an assessment of subjective factors and that it is best understood within the wider context of the Convention as a whole. BIBLIOGRAPHIC LEVEL: part of a serial Substantive rights and equal treatment in respect of religion and belief : towards a better understanding of the rights and their implications / Moon, Gay ; Allen, Robin REFERENCE TO GENERIC UNIT (Periodica): European human rights law review : issue 6., p. 580-602. - London : Sweet & Maxwell, 2000. - ISSN 1361-1526 LANGUAGE: ENG ABSTRACT: In this article, the authors analyse the rapidly developing law relating to religious rights and equal treatment, in the context of a society that, though moving towards social inclusivity, retains many social constructs based in Christianity. The protections afforded to religious belief by Article 9 of the European Convention on Human Rights, and Article 13 of the E.C. Treaty are considered, as are the likely impact of the E.U. framework directive on discrimination, and of the additional equal treatment protection afforded by Protocol 12 ECHR. Noting the limitations of the protection offered to some religious beliefs by current national as well as European Convention law, the authors advocate a fresh approach to the balancing of religious rights, entailing a reassessment of current religious social constructs. The authors identify a need for coherence in the development of this area of the law, and propose a programme for reform of the law regarding religious freedom and equality in the areas of employment, education, public order and matters of State.
